La libertad de expresión en Europa

Abstract

[ES] El derecho a la libertad de expresión ostenta un lugar especial en nuestras sociedades, garantizando el adecuado funcionamiento de las democracias. La protección europea de este derecho viene tanto de la jurisprudencia del Tribunal de Justicia de la Unión Europea como de la procedente del Tribunal Europeo de Derechos Humanos, cobrando especial importancia la de este último. A pesar de su trascendencia, la libertad de expresión no es absoluta y admite limitaciones en base a los fines legítimos establecidos en el artículo 10 del CEDH. Este trabajo analizará tanto el contenido de la libertad de expresión como las restricciones legítimas e ilegítimas a las que se ha visto sometido.

[EN] The right of freedom of expression plays a special role in our societies by guaranteeing the proper function of our democracies. European protection of this right stems not only from the case law of the European Court of Justice but also from the European Court of Human Rights. Special relevance is given to the latter. Despite its relevance, the right of freedom of expression is not absolute and it may be restricted based on the legitimate aims stated in article 10 ECHR. This research will analyze both the content of the freedom of expression and the legitimate and illegitimate restrictions of the right.
