[ES] Para hacer frente a la crisis sanitaria provocada por la pandemia del COVID-19, se han dictado multitud de normas que en muchas ocasiones han conllevado un efecto restrictivo en el ejercicio de derechos fundamentales entre los cuales se encuentra el derecho de libertad religiosa, derecho natural cuya titularidad está atribuida a los individuos y las confesiones religiosas; estas últimas por su parte, tratarán de cumplir los preceptos sanitarios y adoptarán decisiones que de igual modo vendrán a condicionar la práctica del derecho. Por otra parte, corresponderá a los órganos jurisdiccionales enjuiciar la pertinencia y proporcionalidad de las medidas adoptadas en cada caso y en último término, será el máximo intérprete de la Constitución, el que se pronuncie acerca de la idoneidad de la elección del estado de alarma como marco de cobertura legal escogido para hacer frente a esta amenaza global.
[EN] To deal with the health crisis caused by the COVID-19 pandemic, a multitude of regulations have been enacted that on many occasions have had a restrictive effect on the exercise of fundamental rights, among which is the right to religious freedom, natural right whose ownership is attributed to individuals and religious denominations; the latter, for their part, will try to comply with health precepts and will adopt decisions that will also condition the practice of law. On the other hand, it will be up to the jurisdictional bodies to judge the pertinence and proportionality of the measures adopted in each case and ultimately, it will be the highest interpreter of the Constitution, the one that pronounces on the suitability of the election of the state of alarm as framework of legal coverage chosen to deal with this global threat.
