La memoria democrática. análisis historico-normativo: Ley 52/2007 y proyecto de ley de memoria democrática.

Abstract

[ES] La memoria entendida como la capacidad individual o colectiva de recordar hechos del pasado, es el eje conductor para acercarnos a la verdad. El presente trabajo analiza las diferencias conceptuales entre “Memoria Histórica” y “Memoria Democrática”, explicando sus orígenes, su razón de ser y los objetivos que plantean. Sin olvidar que son consecuencia de los hechos acontecidos durante la Guerra civil, la dictadura y la represión consiguiente, así como del tratamiento legislativo que se dio a las víctimas y sus familiares durante la Transición y la Democracia. Por ello, se analiza el desarrollo normativo estatal — concretamente la Ley 52/2007 y el novedoso Proyecto de Ley de Memoria Democrática — junto con la aproximación al desarrollo normativo de algunas Comunidades Autónomas. Así mismo, se hace especial hincapié en los aspectos internacionales más sobresalientes que han orientado y condicionado la aprobación de las leyes antes citadas en nuestro país. [EN] Memory, understood as the individual or collective capacity to remember events from the past, is the driving force to get closer to the truth. This work analyzes the conceptual differences between “Historical Memory” and “Democratic Memory”, explaining their origins, their reason for being and the objectives they set. Without forgetting that they are a consequence of the events that occurred during the Civil War, the dictatorship and the consequent repression, as well as the legislative treatment that was given during the Transition and Democracy, to the victims and their families. For this reason, the state regulatory development is analyzed — specifically Act 52/2007 and the new Democratic Memory Bill— with the approximation to the regional regulatory development of some Autonomous Communities. Likewise, special emphasis is placed on the most outstanding international aspects that have guided and conditioned the approval of the aforementioned laws in our country.
