[ES] El agente encubierto y el agente encubierto informático son figuras recientes en el
ordenamiento jurídico español, empleadas como diligencias de investigación en procesos
penales de criminalidad organizada y de delitos realizados por medio de Internet, en los que no
cabe otra medida que permita obtener piezas de convicción acerca del hecho delictivo. Su
designación bajo identidad supuesta, sus actuaciones en la infiltración regidas por una serie de
límites y garantías y su presencia posterior en el juicio oral serán tratadas en el trabajo, sobre
todo en atención a la medida más reciente referida al agente encubierto informático. De esta
manera, podremos comprobar la absoluta necesidad de una diligencia como esta en nuestra
normativa procesal penal ante la realidad, continuamente cambiante, de la tecnología a la que,
rápidamente, se adaptan los delincuentes. Para ello, contemplaremos específicamente la
actuación del agente encubierto informático en delitos cometidos sobre menores como son el
grooming y aquellos relativos a la pornografía infantil. Con ello, podremos confirmar, con
absoluta evidencia, que el Derecho debe evolucionar según las circunstancias lo requieran para
atajar los sucesivos y novedosos comportamientos delictivos.
[EN] The undercover agent and the computer undercover agent are recent figures in the Spanish legal
system, used as investigative procedures in criminal proceedings of organized crime and crimes
carried out through the Internet. In both of them, there is no other measure that allows obtaining
pieces of conviction about the criminal act. His designation under assumed identity, his actions
in the infiltration governed by a series of limits and guarantees and his subsequent presence in
the oral trial will be treated in the project, especially in attention to the most recent measure
referred to the computer undercover agent. In this way, we will be able to verify the absolute
need for a diligence like this in our criminal procedural regulations in the face of the constantly
changing reality of the technology to which criminals quickly adapt. For this, we will
specifically contemplate the performance of the undercover computer agent in crimes
committed against minors, such as grooming and those related to child pornography. With this,
we will be able to confirm, with absolute evidence, that the Law must evolve as the
circumstances require it to stop the successive and new criminal behaviors.
