Libertad de expresión: sus potenciales límites en los discursos de odio hacia colectivos vulnerables: énfasis en la jurisprudencia del TC y TEDH

Abstract

[ES] El respeto al derecho a la libertad de expresión es un requisito esencial para el funcionamiento del Estado democrático, a la vez que es condición y llave de otros derechos y libertades públicas. No obstante, su mal uso a través de los discursos de odio (hate speeches) puede llevar a que los enemigos de la democracia bajo el ejercicio de dicho derecho, atenten contra el mismo sistema que les brinda la oportunidad de manifestar sus ideas. De esta forma, y a causa de la preocupante oleada de intolerancia marcada por el racismo, xenofobia, LGTBIfobia y aporofobia (entre otras), agravada por su propagación a través de las redes sociales, encuentro imprescindible investigar, analizar y resolver de la manera más proporcional posible y sin riesgo de atacar a la libertad de expresión, los más graves discursos de odio. [EN] Respect for the right to freedom of expression is an essential requirement for the functioning of the democratic state, as well as a condition and key to other public rights and freedoms. However, its misuse through hate speeches can lead the enemies of democracy, through the exercise of this right, to attack the very system that gives them the opportunity to express their ideas. In this way, and because of the worrying wave of intolerance marked by racism, xenophobia, LGTBIphobia and aporophobia (among others), aggravated by its propagation through social networks, I find it essential to investigate, analyse and resolve the most serious hate speeches in the most proportional way possible and without the risk of attacking freedom of expression.
