Sustitución fideicomisaria y legítimas del discapacitado tras la reforma: el artículo 808.4 del Código Civil

Abstract

[ES] El sistema de legítimas que regula el Código Civil se caracteriza por su rigidez, ya que el principal principio por el que se rige es el de la intangibilidad tanto cuantitativa como cualitativa, en favor de los herederos forzosos. No obstante, una de sus excepciones más notable, en el ámbito de la legítima estricta, viene recogida en el artículo 808.4 CC. Ese precepto fue introducido por la Ley 41/2003 y establecía una sustitución fideicomisaria sobre la legítima estricta a favor de un hijo o descendiente incapacitado, mostrando una visión protectora hacia esos sujetos. Sin embargo, dicho artículo ha sido modificado por la Ley 8/2021 estableciendo una serie de cambios en la lectura del artículo mencionado, en lo que a los sujetos y al tipo de sustitución fideicomisaria se refiere. Pero, a pesar de su nueva redacción, sigue habiendo cuestiones interpretativas pendientes de ser solucionadas. [EN] The system of reserved shares regulated by the Civil Code is characterized by its rigidity, since the main principle by which it is governed is intangibility, both quantitative and qualitative, in favour of the forced heirs. However, one of its most notable exceptions, in the area of the strict reserved share, is contained in Article 808.4 CC. That precept was introduced by Law 41/2003 and established a trustee substitution on the strict reserved portion in favour of an incapacitated child or descendant, showing a protective vision towards these subjects. However, said article has been modified by Law 8/2021 establishing a series of changes in the reading of the mentioned article, as far as the subjects and the type of trusteeship substitution is concerned. However, in spite of its new wording, there are still some interpretative questions pending to be solved.
