La objeción de conciencia a tratamientos médicos: especial referencia a la negativa de los Testigos de Jehová a recibir transfusiones sanguíneas

Abstract

[ES] La objeción de conciencia es, hoy en día, un tema de disputa controvertido. En primer lugar, el trabajo se centra en su estudio y en cómo ha surgido la objeción de conciencia a tratamientos médicos debido a la aparición de avances en el ámbito sanitario. Por otra parte, debido a la diversidad cultural de la sociedad a nivel ideológico y religioso, la negativa de los Testigos de Jehová a recibir transfusiones sanguíneas es considerada uno de los problemas más polémicos de este tipo de objeción de conciencia, siendo el ejemplo más claro del debate (entendiendo que también existen otras confesiones religiosas que plantean problemáticas de esta naturaleza) que surge sobre la colisión entre el derecho a la libertad religiosa y el derecho a la vida. En segundo lugar, el propósito de este estudio se centra en analizar la escasa legislación que se encuentra sobre el tema (Ley 41/2002, de 14 de noviembre y Circular de la Fiscalía General del Estado 01/2012) y estudiar la múltiple jurisprudencia que ha establecido precedentes sobre esta cuestión. Se examina cómo afecta a cada individuo dependiendo de sus características (mayor de edad, incapaz, etc.) y cuál es el derecho que prevalece en cada caso, destacándose que la autonomía de la voluntad es cada vez más importante. [EN] Conscientious objection is, nowadays, a controversial topic of dispute. First, the paper focuses on its study and how conscientious objection to medical treatment has arisen due to the emergence of advances in the healthcare field. On the other hand, due to the cultural diversity of society at the ideological and religious level, the refusal of Jehovah's Witnesses to receive blood transfusions is considered one of the most controversial problems of this type of conscientious objection, being the clearest example of the debate (understanding that there are also other religious confessions that raise problems of this nature) that arises about the collision between the right to religious freedom and the right to life. Secondly, the purpose of this study focuses on analyzing the scarce legislation found on the subject (Law 41/2002, of November 14 and State Attorney General's Office Circular 01/2012) and studying the multiple case law that has established precedents on this issue. It examines how it affects each individual depending on their characteristics (adult, incapable, etc.) and which law prevails in each case, highlighting that the autonomy of will is becoming increasingly important.
