El régimen de visitas en caso de violencia de género: la Ley 8/2021, de 2 de junio

Abstract

[ES] En toda crisis matrimonial en la que intervengan hijos menores de edad es necesario configurar un régimen de visitas para que el progenitor no custodio pueda pasar tiempo con sus hijos. Las visitas son, por una parte, un derecho del hijo, y por otra, un derecho-deber del progenitor. Sin embargo, hay ciertas circunstancias que pueden dar lugar a una limitación o suspensión de este régimen, en especial aquellas que perjudiquen al interés superior del menor. Y una de ellas es la violencia de género. Durante años no se ha considerado al menor como víctima de este tipo de violencia, pero esto ha cambiado y ya se le reconoce como víctima directa de la misma. El último paso en esta dirección es la Ley 8/2021 de 2 de junio, cuyo objetivo es aumentar la protección del menor contra la violencia y que establece la suspensión del régimen de visitas en casos de violencia de género y violencia doméstica. These visits are, on the one hand, the child´s right, and on the other hand, a right and an obligation for the parent. However, there are certain circumstances that may lead to a limitation or even a suspension of this regime, especially those that damage the best interest of the child. One of these is gender-based violence. For years, minors have not been considered victims of this type of violence, but this has changed and now they are recognized as its direct victim. The latest step in this direction is the 2th of June 8/2021 Act, which aims to increase the protection of minors against violence and establishes the suspension of visitation regimes in cases of gender-based violence and domestic violence.
