[EN] In our country, the debate on the crimi-
nalization of the exaltation of the Franco regime has
been opened. German law is often cited as a model
where the exaltation of a totalitarian regime is pun-
ished. However, this legislation typifies support for
National Socialist violence and tyranny, when it dis-
turbs the public peace and damages the dignity of the
victims (§ 130.4 StGB). In addition, the Federal Con-
stitutional Court has rejected that the object of protec-
tion is dignity because this quality is the same in the
victims of all dictatorships and the precept only pro-
tects those of Nazism. Based on our constitutional ju-
risprudence, I believe that the proposed reform of the
Criminal Code should not incorporate this figure into
Article 510. The general criterion announced by the
Government to punish only the most serious conduct
that affects freedom of expression seems correct
