El enaltecimiento de la tiranía nacionalsocialista en el derecho alemán. ¿Un referente para penalizar el ensalzamiento del franquismo?

Abstract

[ES] En nuestro país se ha abierto el debate sobre la penalización del enaltecimiento del franquismo. Se suele citar el Derecho alemán como modelo donde se castiga el ensalzamiento de un régimen totalitario. Sin embargo, en esta legislación se tipifica el apoyo a la violencia y tiranía nacionalsocialista, cuando perturbe la paz pública y lesione la dignidad de las víctimas (§ 130.4 StGB). Además, el Tribunal Constitucional Federal ha rechazado que el bien jurídico protegido sea la dignidad porque esta cualidad es igual en las víctimas de todas las dictaduras y el precepto solo tutela a las del nazismo. Partiendo de nuestra jurisprudencia constitucional, creo que en la proyectada reforma del Código penal no se debe incorporar esa figura al artículo 510. Me parece correcto el criterio general anunciado por el Gobierno de penalizar solo las conductas más graves que afectan a la libertad de expresión.
