Los desafíos que enfrenta la codificación civil en el Derecho español

Abstract

[ES] El objeto de este trabajo es poner de relieve la necesidad de reformar del Código Civil español para adaptarlo a las nueva realidad social, económica y tecnológica española y, para ello, está estructurado en cuatro partes: una breve introducción que nos acerque al tema objeto de estudio; en segundo lugar se presentan los problemas que el Código Civil español muestra; seguidamente, se expone, de forma muy breve, la Propuesta para la modernización del derecho de obligaciones y contratos que presentó la Comisión General de Codificación en 2009 y, en último lugar, la propuesta de Código Civil que la Asociación de Profesores de Derecho Civil realizó en 2018. [EN] The purpose of this paper is to highlight the need to reform the Spanish Civil Code in order to adapt it to the new Spanish social, economic and technological reality. The paper is structured in four parts: a brief introduction presenting the subject under study; the exposition of some of the problems that the Spanish Civil Code shows; thirdly and very succinctly, the presentation of the Proposal for the modernisation of the Law of Obligations and Contracts of the General Codification Commission in 2009 and, lastly, the analysis of the Proposal for a Civil Code that the Association of Civil Law Professors made in 2018
