La actividad consultiva y el Consejo de Navarra (1516-1622)

Abstract

[ES] El objetivo de este trabajo es estudiar la participación que tuvo el Consejo de Navarra, a través de las sucesivas disposiciones y ordenanzas que rigieron sus destinos, en el proceso de configuración del régimen jurídico de las consultas conciliares entre 1516 y 1622. La delimitación cronológica está determinada por la importancia de estas dos fechas en la vida del Consejo de Navarra, el comienzo en 1516 de su trayectoria tras la incorporación del reino a la Corona de Castilla en las Cortes de Burgos de 1515 y la recopilación en 1622 del corpus documental que reguló el devenir de este Consejo hasta el siglo XIX. Por otra parte, fueron años en los que se publicaron las más importantes normas de rango principal que regularon la organización y actuación de los diversos consejos de la Monarquía Hispánica, incluida su actividad consultiva. Las aportaciones del Consejo de Navarra a la configuración del régimen jurídico de las consultas están condicionadas y lastradas por la conservación de su sede en Pamplona tras la integración en Castilla, ya que esta particularidad provocó diferencias en el desenvolvimiento de su actividad consultiva respecto a la de todos los demás consejos territoriales que estaban ubicados en Madrid [EN] The objective of this work is to study the participation of the Council of Navarre, through the successive dispositions and ordinances that governed its destinies, in the process of configuration of the juridical regime of the conciliar consultations between 1516 and 1622. The chronological delimitation is determined by the importance of these two dates in the life of the Council of Navarre, the beginning in 1516 of its trajectory after the incorporation of the kingdom to the Crown of Castile in the Cortes of Burgos in 1515 and the compilation in 1622 of the documentary corpus that regulated the evolution of this Council until the 19th century. On the other hand, these were years in which the most important norms of principal rank were published that regulated the organization and action of the various councils of the Hispanic Monarchy, including their consultative activity. The contributions of the Council of Navarre to the configuration of the legal regime of consultations are conditioned and weighed down by the preservation of its seat in Pamplona after its integration into Castile, since this particularity caused differences in the development of its consultative activity with respect to that of all the other territorial councils which were located in Madrid
