La racionalización técnica en la contratación pública como alternativa a los contratos menores

Abstract

[ES] Analizar, tras la nueva Ley de Contratos del Sector Público, la situación en la que quedan los denominados contratos menores conlleva no sólo realizar un estudio del régimen actual de esta figura, si no que exige hacer una reflexión sobre la necesidad de adecuar a los nuevos tiempos una fórmula, que aunque práctica, tiende a la obsolescencia sobre todo por la falta de transparencia que implica. Procuramos abordar la cuestión en sí del contrato menor, desde la perspectiva que plantea su limitación y las posibles soluciones que ofrece el texto de la Ley de Contratos del Sector Público como alternativa. Dentro de éstas, se encuentra la llamada racionalización técnica, o lo que es lo mismo, la compra conjunta en todas sus formas, llámese contratación centralizada -centrales de compras-, acuerdos marco y contratos basados, o los más novedosos, por su carácter eminentemente electrónico, sistemas dinámicos de adquisición.
