Tutela judicial efectiva y migraciones: perspectivas desde la asistencia jurídica gratuita y la cultura 'pro bono'

Abstract

[ES] Aún lejos de un diseño general de políticas públicas basadas en el reconocimiento de las personas migrantes como sujetos titulares de derechos humanos y, en un contexto de especial vulnerabilidad, centraremos nuestro estudio en un examen pormenorizado a la luz de la jurisprudencia constitucional del derecho a la tutela judicial efectiva como elemento clave para la protección del resto de derechos y garantía de su efectividad, y del derecho a la asistencia jurídica gratuita como instrumento de desarrollo de aquel derecho fundamental; no obstante, dado el interés que ha suscitado la cultura “pro bono” en esta materia como función social de la Abogacía, ofreceremos también una visión general de las luces y sombras que presenta esta práctica frente al turno de oficio. [EN] Still far from a general design of public policies based on the recognition of migrants as subjects entitled to human rights and, in a context of special vulnerability, we will focus our study on a detailed examination in light of the constitutional jurisprudence of the right to effective judicial protection as a key element for the protection of the rest of rights and guarantee of their effectiveness, and the right to free legal assistance as an instrument of development of that fundamental right; however, given the interest that the “pro bono” culture has aroused in this matter as a social function of the Legal Profession, we will also offer an overview of the lights and shadows that this practice presents in comparison with the in-court representation services.
