Gender Perspective in the Justice of the Future: Reflections on Artificial Intelligence and Alternative Dispute Resolution

Abstract

[EN] Artificial intelligence and Alternative Dispute Resolution (ADR) have become the two main axes on which to build a new, more efficient model of justice, aimed at promoting better access to justice. Thus, taking into account that artificial intelligence is already a reality in many areas of daily life, as well as in the field of justice, where it has been shown to develop multiple applications, and even in the sphere of extra-judicial conflict resolution, this paper proposes to analyse the compatibility of artificial intelligence systems with respect for human rights and fundamental rights and freedoms, specifically with the access to justice right and, more specifically, with its exercise by women under conditions of equality insofar as one of the factors that stands out as the main cause of vulnerability is precisely gender. In this context, the question that arises concerns the place that new challenges in the field of justice such as artificial intelligence —and its development in ADR systems— may have in the desideratum of gender equality. [ES] La inteligencia artificial y los medios alternativos de resolución de conflictos (ADR) se han convertido en los dos grandes ejes sobre los que vertebrar un nuevo modelo de justicia más eficiente, dirigidos a promover un mejor acceso a la justicia. Así pues, teniendo en cuenta que la inteligencia artificial representa ya una realidad en numerosos ámbitos de la vida diaria, al igual que en materia de justicia, donde ha demostrado desarrollar múltiples aplicaciones, e incluso en la esfera de la resolución extrajurisdiccional de conflictos, en este trabajo se propone analizar la compatibilidad de los sistemas de inteligencia artificial con el respeto de los derechos humanos y los derechos y libertades fundamentales, en concreto, con el derecho de acceso a la justicia y, más específicamente, con su ejercicio por parte de la mujer en condiciones de igualdad en la medida en que uno de los factores que se erige como causa principal de vulnerabilidad es precisamente el género. En este orden, el interrogante que se plantea es el relativo al encaje que los nuevos retos en materia de justicia como la inteligencia artificial —y su desarrollo en los sistemas ADR— pueden llegar a tener en ese desiderátum que representa la igualdad de género.
