Refugees in the European Union: history, legal status, and challenges

Abstract

[EN] The refugee conflict in the European Union is the result of a historical process that has deep roots in various parts of Africa and the Middle East. Community efforts to solve this problem have been accentuated since the serious migratory crisis that hit the group of twenty-seven in 2015. This dissertation aims to delve into the historical processes concerning the flow of refugees, the various legal statuses they can acquire, and the judicial and logistical obstacles faced by the European Union in this matter, with emphasis on the existing and debated legislation surrounding the problem. [ES] El conflicto de refugiados que vive la Unión Europea obedece a un proceso histórico que tiene profundas raíces en diversos puntos de África y Oriente Medio. Los esfuerzos comunitarios por resolver este problema se acentuaron a partir de la grave crisis migratoria que azoto al grupo de los veintisiete en 2015. Esta disertación pretende profundizar en lo concerniente a los procesos históricos de flujo de refugiados, los diversos estatus legales que pueden adquirir y los obstáculos judiciales y logísticos a los que se enfrenta la Unión Europea en esta materia, poniendo énfasis en la legislación existente y debatida en torno al problema.
