Amnistías en las políticas hacia el pasado traumático: el caso de Uruguay

Abstract

[ES] El presente estudio busca aproximarse a la transición democrática uruguaya a través del análisis del impacto de la Ley de Caducidad. Esta ley, aprobada en 1986, impidió durante más de dos décadas la investigación y sanción de los crímenes cometidos por las Fuerzas Armadas durante la dictadura cívico-militar. A través del estudio de esta ley se ha optado por explorar dos grandes líneas temáticas: por un lado, el impacto político e institucional de la ley en el proceso de justicia transicional y, por otro, su influencia en la construcción de la memoria histórica sobre el pasado traumático. Desde esta doble perspectiva, se abordan cuestiones como las negociaciones del Club Naval, los límites impuestos a la justicia, los referéndums de 1989 y 2009, y las formas de resistencia impulsadas desde la sociedad civil. En líneas generales, este trabajo busca ofrecer una reflexión crítica sobre cómo determinadas leyes que son presentadas como mecanismos de reconciliación acaban consolidando la impunidad y dificultando el reconocimiento de las víctimas. [EN] This study aims to approach Uruguay’s democratic transition through an analysis of the impact of the Statute of Limitations. This law, passed in 1986, prevented for over two decades the investigation and prosecution of crimes committed by the Armed Forces during the civic-military dictatorship. Through the study of this law, two main thematic lines have been chosen for exploration: on the one hand, the political and institutional impact of the law on the transitional justice process; and on the other, its influence on the construction of historical memory regarding the traumatic past.

From this dual perspective, the study addresses issues such as the Naval Club negotiations, the limits imposed on justice, the referendums of 1989 and 2009, and the forms of resistance driven by civil society.

Overall, this work seeks to offer a critical reflection on how certain laws, presented as mechanisms of reconciliation, end up consolidating impunity and hindering the recognition of victims.
