Occupatio como modo de adquisición de la propiedad en Derecho romano

Abstract

[ES] El objeto del presente trabajo es ofrecer un análisis pormenorizado de la occupatio en el Derecho romano. Para ello, se estudia cuál es su origen en el Ius gentium, por qué se puede afirmar que crea un derecho de propiedad, así como el hecho de que cualquier individuo puede ocupar. Se continúa estudiando en detalle los requisitos para que verdaderamente esta figura despliegue todos sus efectos, así como los tipos de cosas que, potencialmente, son susceptibles de ser adquiridas mediante esta institución. En este sentido, veremos cómo el carácter de ser una figura de Derecho de gentes no sólo afecta al concepto de occupatio en sí mismo, sino igualmente a las cosas que son susceptibles de ser ocupadas. Igualmente, se analizan los efectos de la occupatio, es decir, qué tipo de propiedad se adquiere una vez se cumplen los requisitos de esta institución. Finalmente, se exponen las conclusiones que se extraen de esta investigación. [EN] The aim of this paper is to offer a deep analysis of the occupatio in roman Law. In this regard we have studied what its origins in Ius gentium are, why we can affirm that it creates a right to property, as well as the fact that any individual can occupy. We continue studying in detail the conditions that have to be met so that it produces all of its effects and also the things that, potentially, are prone to be acquired through this institution. In this regard, we will see that the character of being a figure of Ius gentium does not only affect the concept of occupatio in itself, but also the things that potentially can be occupied. Equally, we study the effects of the occupatio, meaning which kind of property can be acquired once all requirements are met. Finally, we explain the conclusions that can be drawn from this research.
