Evaluación de la validez y credibilidad del testimonio en menores

Abstract

[ES] La evaluación de la validez y la credibilidad de los testimonios infantiles no es una tarea fácil y requiere de conocimientos específicos sobre Psicología del Testimonio y el desarrollo del menor. Los menores son un grupo muy heterogéneo y por ello debemos adaptar todas las fases del proceso al desarrollo específico de cada persona. Para ello, es fundamental partir de una adecuada planificación. La primera fase del proceso de valoración de un testimonio consiste en recopilar y analizar toda la información del caso. En la segunda se valoran las capacidades para testificar del menor y en la tercera se obtiene su testimonio a través de una entrevista narrativa en formato libre, en algunos casos en forma de prueba preconstituida. Si el testimonio del menor tiene una extensión y calidad suficientes, se procede con la última fase del proceso que consiste en la evaluación el testimonio. Existen múltiples herramientas para la evaluación de la validez y credibilidad de las declaraciones de los menores. Conocer cómo funcionan y sus limitaciones es fundamental para utilizar estas herramientas en los casos necesarios y no hacerlo de forma indiscriminada ante cualquier persona o tipo de caso.

[EN] The assessment of the validity and credibility of child testimonies is not an easy task and requires specific knowledge about Psychology of Testimony and child development. Children represent a highly heterogeneous group, and therefore, all phases of the process must be adapted to the specific development of each individual. To do this, it is essential to start with proper planning. The first phase of the testimony assessment process involves collecting and analysing all case-related information. Secondly, the child’s capacity to testify is evaluated. In the third phase, their testimony is obtained through a free-form narrative interview, in some cases as a pre-recorded statement. If the child’s testimony is of sufficient length and quality, the final phase of the process involves evaluating the testimony. There are multiple tools available for assessing the validity and credibility of children’s statements. Understanding how these tools work and their limitations is crucial for using them where necessary and not applying them indiscriminately to any individual or type of case.
