Los valores de la sociedad europea y su reflejo en las Iniciativas Ciudadanas Europeas: el caso de la ICE Against Conversion Therapy

Abstract

[ES] El objetivo de este trabajo es caracterizar los valores de la sociedad europea y estudiar cómo pueden llegar a tener un reflejo claro en el Derecho de la Unión. En este caso, analizamos el contenido de los valores del art. 2 TUE y cómo se relacionan con las Iniciativas Ciudadanas Europeas como mecanismo de democracia directa y, concretamente, con la Iniciativa Ciudadana Europea Against Conversion Therapy. El trabajo se estructura de la siguiente forma. Primeramente hacemos una introducción del objeto de estudio en la que exponemos cuál es el objetivo perseguido con esta investigación así como el motivo por el consideramos es relevante. En segundo lugar, definimos el concepto de sociedad europea así como analizamos detalladamente cada uno de los valores sobre los que ésta se asienta. En tercer lugar, estudiamos cómo los valores del art. 2 TUE definidos previamente se ven reflejados en el instrumento de las Iniciativas Ciudadanas Europeas y especialmente en la llamada ICE ACT. En última instancia, presentamos las conclusiones de esta investigación. [EN] The objective of this paper is to characterize the values of the European society and to study how they can be clearly reflected in European Union Law. In this case, we analyse the content of the values in art. 2 TEU and how they relate to European Citizens Initiatives as a mechanism of participatory democracy and, specifically, with the European Citizens Initiative Against Conversion Therapy. This paper is structured as it follows. First, we introduce the case of study and define the objective of this dissertation as well as why we consider it to be relevant. Secondly, we define the concept of European society and analyse each of the values it is founded upon. In the third place, we study how art. 2 TEU values as defined previously are reflected on the instrument of European Citizens Initiative and specially in the so-called ECI ACT. Lastly, we present the conclusions that can be drawn from this research.
