Las uniones de hecho y su régimen económico

Abstract

[ES] En la sociedad actual existen distintas formas de convivencia distintas al matrimonio, entre las que se encuentra la pareja de hecho. En particular, el aumento del considerable del número de parejas de hecho ocasiona que estemos ante un nuevo modelo de familia que cada vez adquiere mayor importancia como alternativa, transitoria o definitiva, a la unión matrimonial. En el presente trabajo se analizará, por tanto, la figura de las parejas o uniones de hecho, atendiendo sobre todo a la esfera económica. En concreto, la primera parte del trabajo abordará de forma general esta institución, analizando aspectos como su régimen jurídico, los motivos del nacimiento de estas uniones o los requisitos necesarios para su consideración como tal. Además, se ofrecerá un concepto de lo que se debe entender por pareja de hecho. Por otro lado, en una segunda parte del trabajo se analizará detalladamente el régimen económico al que se acogen actualmente de las parejas de hecho, tanto durante la convivencia como tras la ruptura de la misma. Por último, en una tercera y última parte del trabajo se aportarán unas conclusiones de lo analizado con anterioridad.

[EN] In modern society there exist several forms of coexistence different to marriage, one of which is common-law marriage. In particular, the considerable increase in the number of stable unions causes a new model of family, which is also becoming a more and more important alternative, transitory or definitive, to marriage. The present paper will analyze, therefore, the figure of common-law marriages or stable unions, pertaining especially to the economic system. In particular, the first part of the paper defines the concept of common-law marriages and address this institution in a generic way, analyzing aspects such as its legal regime, the key circumstances that lead to a common-law marriage or the requirements needed to be considered so. Furthermore, the second part of this paper will analyze in detail the economic system that the common-law marriages invoke, both during the coexistence and after separation. Finally, the third part of the paper will provide some conclusions of the matters previously analyzed.
