Resumen
[ES]El delito de enriquecimiento ilícito se introdujo en España mediante LO 14/2022 de 22 de diciembre. El objetivo del mismo es luchar contra la corrupción y sancionar cuando no es posible probar el origen ilícito de los bienes que detenta una autoridad pública. Nuestro legislador, consciente de las dudas de legitimidad que rodean a este tipo en derecho
comparado, dice apartarse de la configuración dada al mismo en la Convención de Naciones Unidas Contra la Corrupción y configurarlo como un delito de desobediencia. A lo largo del
trabajo se analiza si verdaderamente estamos ante un delito por el que se sanciona la no contestación a un requerimiento mediante el se le pide a la autoridad que explique el origen de sus bienes, o si el núcleo del injusto se encuentra en la sospecha de que el incremento patrimonial procede de la comisión de un previo delito de corrupción que no se ha conseguido probar. Así mismo, se analiza si este tipo es respetuoso con los principios de
legalidad, lesividad y proporcionalidad y con el derecho a la presunción de inocencia, a permanecer en silencio y a no autoincriminarse. [EN]The crime of illicit enrichment was introduced in Spain through Law 14/2022 of
December 22. Its porpouse is to fight corruption and to punish when it is not possible to prove the illicit origin of the assets held by a public authority. Our legislator, aware of the doubts of legitimacy surrounding this type of offence in comparative law, states a departure from its configuration in the United Nations Convention Against Corruption, framing it as a disobedience crime. Throughout the study, an analysis is conducted to determine it is indeed an offense punishing the refusal to respond to a request asking the authority to explain the origin of their assets, or whether the core of the crime lies in the suspicion that the increase
in assets comes from the commission of a previous crime of corruption that has not been
proven. It also analyses whether this offence respects the principles of legality, harmfulness
and proportionality and the right to be presumed innocent, the right to remain silent and the right not to incriminate oneself.
