Justicia penal de menores, delitos de odio e inteligencia artificial: situaciones procesales

Abstract

[ES] Nuestra sociedad asiste al crecimiento de un tipo delictivo especialmente injusto, discriminatorio y muy vinculado a las redes sociales, como son los delitos de odio. Los menores de edad no son ajenos a esta realidad y también puede cometer dichas infracciones viéndose abocados al correspondiente proceso penal en el cual determinar su responsabilidad penal y las medidas a imponer en sentencia. El tercer factor que integra el presente trabajo es la inteligencia artificial, como tecnología disruptiva, y cuya implementación en el ámbito de la administración de justicia puede servir como elemento de asistencia a los órganos jurisdiccionales en la realización de determinadas actuaciones y resoluciones procesales. Analizamos cómo ante menores infractores en delito de odio la inteligencia artificial puede ser una herramienta válida y eficaz, al servicio de los Juzgados y Fiscalías de Menores, para llevar a cabo actuaciones como la evaluación criminológica del menor, la valoración del riesgo de reincidencia o la idoneidad de las medidas a imponer en sentencia y su eventual modificación, sustitución o suspensión.

[EN] Our society is witnessing the growth of a type of crime that is especially unfair, discriminatory and closely linked to social networks, such as hate crimes. Minors are not immune to this reality and can also commit such infractions and be led to the corresponding criminal process in which determine their criminal responsibility and the measures to be imposed in a sentence. The third factor that makes up this work is artificial intelligence, as a disruptive technology, and whose implementation in the field of the administration of justice can serve as an element of assistance to jurisdictional bodies in carrying out certain procedural actions and resolutions. We analyse how, in the case of minor hate crime offenders, artificial intelligence can be a valid and effective tool, at the service of Juvenile Courts and Prosecutor's Offices, to carry out actions such as the criminological evaluation of the minor, the assessment of the risk of recidivism or the suitability of the measures to be imposed in the ruling and their eventual modification, replacement or suspension.
