Filiación de los hijos de parejas del mismo sexo nacidos mediante técnicas de reproducción asistida

Abstract

[ES] Las Técnicas de Reproducción Asistida se configuran como el mecanismo principal para superar los problemas de infertilidad, y debido a su regulación es posible que a día de hoy la mera voluntad de tener un hijo haga que esto sea posible. Este estudio tiene por objeto analizar el procedimiento de acceso a las técnicas de reproducción asistida por parte de parejas del mismo sexo, sus consecuencias legales y las desigualdades existentes en la materia. Por un lado, se examinará la posibilidad de establecer una comaternidad, y por otro, la imposibilidad de obtener una copaternidad derivada de la figura de la gestación por sustitución, de manera que, estudiaremos los argumentos a favor y en contra de la misma, así como la necesidad de regularla con el fin de lograr una igualdad efectiva entre hombres y mujeres

[EN] The Assisted Reproductive Techniques are configured like the main mechanism to overcome the infertility problems, and because the law system, nowadays, it is possible the only wish to have a child, makes it possible. The present study aims to analyse the access´s process to assisted reproductive techniques for same sex couple, their legal consequences and the existing inequality in this subject. On the one hand, the possibility to making a co-maternity will be examined here. On other hand, the impossibility to obtaining a co-paternity proceeds from the surrogate motherhood, so that, the arguments for and against will be studied, and also the necessity of regulating this, in order to get an effective equality between men and women.
