De iudicio. Variaciones en torno a la potestad y al acto de juzgar

Abstract

El análisis del juicio como decisión judicial permite enlazar consideraciones escolásticas de Santo Tomás con los principales problemas actuales del proceso desde la triple perspectiva de los sujetos encargados de juzgar, del modo en que lo hacen, para llegar de forma conclusiva a ponderar las variables complejas que entran en la definición de qué es el acto de juzgar. Estas reflexiones permiten destacar las relaciones entre el Derecho, la Filosofía y la Psicología en el acto procesal más decisivo y complejo de todos.

The analysis of the judgment as a court decision allows us to link the scholastic considerations of St. Thomas Aquinas with the main procedural current problems from a triple perspective: the subjects who have to decide law cases, the way that they have to do it and its shortcomings, and finally in conclusive way we can think on the complex variables that come into the definition of what is the act of judging.
