Nevertheless the conceptual vagueness persists in spite of the consensus that exists on the problem.
Though it is true, one has legislated stately and instruments of fight have been created to relieve the organized transnational criminality, between them, they stand out, the figure of the secret agent and the mechanism of the monitored delivery. The figure of the provocative agent in spite of lacking legal regulation is very used as police diligence of investigation and fight against the organized crime, ensuing from special interest the differences and existing similarities between the secret agent and the provocative agent.
Special attention appears in the work in the possible violation of fundamental rights on the part of the agent concealed before certain actions
