Instrumentos jurídicos para luchar contra la criminalidad organizada. Especial atención a la figura del agente encubierto

Abstract

[ES]La abundancia de oportunidades económicas, sociales, culturales y tecnológicas que trae consigo el fenómeno de la globalización, supone al mismo tiempo la expansión de las organizaciones criminales. El crimen organizado se ha globalizado constituyendo un grave problema para la humanidad y para la seguridad internacional. Se han elaborado a nivel comunitario ciertas directivas y han tenido lugar diferentes convenciones en el seno de Naciones Unidas para llegar a un acuerdo en la definición de la organización criminal y poder así establecer mecanismos de lucha más eficaces. Sin embargo la vaguedad conceptual persiste pese al consenso que existe sobre el problema. Si bien es cierto, se ha legislado estatalmente y se han creado instrumentos de lucha para paliar la criminalidad organizada transnacional, entre ellos destacan, la figura del agente encubierto y el mecanismo de la entrega vigilada. La figura del agente provocador a pesar de carecer de regulación legal, es muy utilizada como diligencia policial de investigación y lucha contra el crimen organizado, resultando de especial interés las diferencias y similitudes existentes entre el agente encubierto y el agente provocador. Se muestra especial atención en el trabajo en la posible vulneración de derechos fundamentales por parte del agente encubierto ante ciertas actuaciones.

[EN]The abundance of economic, social, cultural and technological opportunities that brings with it the phenomenon of the globalization, supposes at the same time the expansion of the criminal organizations. The organized crime has been included constituting a serious problem for the humanity and for the international security. Certain directives have been elaborated at the Community level and different conventions have taken place in the bosom of The United Nations to reach an agreement in the definition of the criminal organization and power like that to establish more effective mechanism of fight. Nevertheless the conceptual vagueness persists in spite of the consensus that exists on the problem. Though it is true, one has legislated stately and instruments of fight have been created to relieve the organized transnational criminality, between them, they stand out, the figure of the secret agent and the mechanism of the monitored delivery. The figure of the provocative agent in spite of lacking legal regulation is very used as police diligence of investigation and fight against the organized crime, ensuing from special interest the differences and existing similarities between the secret agent and the provocative agent. Special attention appears in the work in the possible violation of fundamental rights on the part of the agent concealed before certain actions
