La análoga relación de afectividad sin convivencia en los delitos de violencia de género

Abstract

[ES]En este trabajo nos centraremos en la competencia de los Juzgados de Violencia sobre la Mujer, a la hora de conocer aquellos delitos de violencia de género cometidos por un hombre contra una mujer que sea o haya sido su esposa, o mujer que esté o haya estado ligada al autor por análoga relación de afectividad, aun sin convivencia. Siendo el objeto principal del trabajo analizar las diferentes interpretaciones acerca de esta compleja “análoga relación de afectividad sin convivencia” que varían desde la existencia de una perspectiva muy restrictiva, hasta una perspectiva más permisiva o dicho de otro modo, progresista, añadiendo un enfoque personal para interpretar la misma. Con dicho estudio vamos a observar también las diferencias existentes entre este tipo de relaciones que han de ser heterosexuales, con las relaciones homosexuales. Así como también vamos a ver la posible inclusión de las relaciones con personas transexuales y con menores de edad en los delitos de violencia de género.

[EN]In this project the attention is focused on the competence of the Courts of Violence against Women, when it comes to knowing those crimes of gender violence committed by a man against a woman who is or has been his wife, or a woman who is or has been linked to the author by analogous relationship of affectivity, even without cohabitation. Being the main object of the work to analyze the different interpretations about this complex "analogous relationship of affectivity without cohabitation" that vary from the existence of a very restrictive perspective, to a more permissive or otherwise said, progressive perspective, adding a personal approach to interpret it. With this study we will also observe the differences between these types of relationships that have to be heterosexual, with homosexual relationships. As well as we are going to see the possible inclusion of the relationships with transsexual people and with minors in the crimes of gender violence.
