El interés superior del menor en supuestos de gestación por sustitución

Abstract

[EN] Los últimos avances científicos y tecnológicos en el campo de las Técnicas de Reproducción Humana y Asistida han dado lugar a una gran variedad de prácticas y tratamientos, y con ello se introduce la voluntad pro-creacional para determinar la filiación como fórmula alternativa a la filiación biológica y adoptiva. Una de estas técnicas que se encuentra en auge actualmente pese a ser moralmente cuestionada en nuestro país es, la gestación por sustitución. El hecho de que en España exista una regulación insuficiente que declara nulo el contrato de este tipo, la ambigüedad que genera el reconocimiento de algunos efectos y el indeterminado concepto del interés supremo del niño, no hacen sino generar más incertidumbre en torno a esta figura. Aquéllos que deciden trasladarse a países donde está permitida esta práctica, posteriormente a su realización regresan a su país de origen e intentan garantizar la filiación del menor no con éxito en algunas ocasiones. Nos plantearemos a lo largo de este trabajo los retos que presenta su regulación, los intereses de los sujetos involucrados y sobre todo la relevancia del concepto de la dignidad del menor así como la protección del niño como eje central conforme al que gire este trabajo.

Those who decide to move to countries where this practice is allowed, after they return to their country of origin and try to ensure the child's filiation is not successful on some occasions. Throughout this work, we will consider the challenges presented by its regulation, the interests of the subjects involved and, above all, the relevance of the concept of the dignity of the child as well as the protection of the child as the central axis according to which this work turns.
