La guarda y custodia compartida de menores

Abstract

[ES] La custodia compartida es una figura jurídica que en nuestra sociedad cada vez está más demandada, ello nos hace comprender que, en la mayoría de las ocasiones, por diferentes motivos, es más beneficiosa que establecer una custodia exclusiva para uno de los progenitores. Es conveniente no sólo para los hijos menores, sino también para sus respectivos padres ya que supone una situación de igualdad. La posibilidad de establecer la custodia compartida hace, en buena medida, que no se rompa la convivencia del día a día de los menores con sus progenitores. Además, posibilita la buena relación o, al menos, el intento de tener un vínculo cordial entre los padres y un diálogo y colaboración continua respecto de los asuntos que atañen a sus hijos, a pesar de que se haya producido una ruptura matrimonial.

[EN] Shared custody is a legal figure that is increasingly in demand in our society. This makes us understand that on most occasions, for different reasons, it is more beneficial than establishing exclusive custody for one of the parents. It is convenient not only for the minor children, but also for their respective parents since it supposes a situation of equality. The possibility of establishing shared custody makes in good measure that the day-to-day coexistence of minors with their parents is not broken. It also makes possible the good relationship or at least the attempt to have a cordial relationship between the parents and a continuous dialogue and collaboration regarding the issues that concern their children, even though there has been a breakup in marriage
