Abstract

[ES] Los avances y progresos científicos han desarrollado nuevas técnicas de reproducción asistida como alternativa al problema de la esterilidad. El nuevo abanico de posibilidades que se ofrecen plantea diversos problemas en la actualidad. Entre dichas técnicas destacamos la gestación por sustitución, que se ha convertido en una opción muy demandada en los últimos tiempos por aquellas parejas que no pueden tener hijos biológicos. El presente Trabajo de Fin de Grado titulado “Gestación Por Sustitución”, analiza, no sólo los aspectos legales y procedimentales de esta técnica en España, sino también su situación legal a nivel mundial. Así como sus efectos y consecuencias. Se estudia las dificultades que conllevan su determinación, reconocimiento e inscripción en el Registro Civil. Se examina el iter jurisprudencial que ha tenido lugar en España en lo referente a la inscripción. También el fenómeno evolutivo que se ha producido en cuanto a la concesión de la prestación de maternidad en casos de gestación subrogada, avalado por un reciente pronunciamiento del Tribunal Supremo. Por último, se hace referencia a los argumentos a favor y en contra de esta técnica y se exponen posibles soluciones.

[EN] The advances and scientific progress have developed new techniques of assisted reproduction as an alternative to the problem of infertility. The new range of possibilities offered sets out several problems at the moment. Among these techniques we emphasize gestation by substitution, which has become an option demanded in recent times by those couples who can not have biological children. This Final Degree Project entitled “Surrogate Pregnancy", analyzes, not only the legal and procedural aspects of this technique in Spain, but also its legal situation at world-wide level. As well as its effects and consequences. It examines the difficulties that involve its determination, acknowledgement and registration in the Civil Registry. It examines the jurisprudential iter that has taken place in Spain regarding the inscription. Also the evolutionary phenomenon that has happened in regard to the granting of maternity benefit in cases of surrogate gestation, backed by a recent pronouncement by the Supreme Court. Finally, we make reference to the arguments for and against of this technique and possible solutions are showed.
