Abstract

[ES] El presente trabajo versa en torno al análisis del desarrollo y protección del derecho al olvido digital en el mundo virtual. Este estudio se concreta mediante breves referencias a la Agencia Española de Protección de Datos y el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, (entre otros), los cuales nos ofrecen una regulación actual del caso. Además, con la intención de ofrecer una visión más amplia del tema, se ha puesto en relación este derecho al olvido digital con otros derechos como el derecho al honor, la intimidad y la propia imagen (artículo 18 CE) y el derecho a la información y la libertad de expresión (artículo 20 CE). Se analiza una sentencia centrada en el tema, la Sentencia Google Spain, que permitirá ver de una forma más práctica la aplicación, el alcance y la tutela efectiva del derecho al olvido.

[EN] The present work deals with the analysis of the development and protection of the right to digital oblivion in the virtual world. This study is specified through brief references to the Spanish Agency for Data Protection and Regulation (EU) 2016/679 of the European Parliament and the Council, of April 27, 2016, (among others), which offer us a current regulation of the case. In addition, with the intention of offering a broader view of the subject, this right to digital oblivion has been related to other rights such as the right to honour, family privacy and one´s own image (Article 18 EC) and the right to information. and freedom of expression (Article 20 EC). A sentence centered on the subject is analyzed, the Google Spain Sentence, which will make it possible to see in a more practical way the application, scope and effective protection of the right to be forgotten.
