El Consejo General del Poder Judicial: de la independencia judicial al gobierno de jueces y magistrados

Abstract

[ES] El CGPJ como órgano de gobierno del Poder Judicial tiene entre sus funciones principales la de garantizar la independencia de los Jueces y Magistrados que conforman la Carrera Judicial. No obstante, como se observará en el contenido del trabajo, esta función no es única, ya que el CGPJ cuenta con otras funciones relacionadas directamente con el gobierno del Poder Judicial, como es la función disciplinaria directamente ejercida sobre Jueces y Magistrados. Es por ello, que se debe analizar las posibles vulneraciones de la independencia judicial que puede causar el poder político. A partir de la CE de 1978, con la influencia de Estados de nuestro entorno tales como Francia, Italia o Portugal, se establece un sistema de composición y designación de los miembros del CGPJ en el art. 122.3, remitiéndose, para su complemento, al desarrollo legislativo. Realizando un análisis (en una triple dimensión; legislativa, doctrinal y jurisprudencial) de las diversos sistemas establecidos por el legislador (partiendo de la LO 1/1980, de 10 de enero hasta la última reforma llevada a cabo a través de la LO 4/2013, de 28 de junio) observamos cómo se ha producido un viraje hacia el mayor intervencionismo de las Cortes Generales en el procedimiento de nombramiento de los vocales del CGPJ y una relativa corrección posterior.

[EN] The GCPJ, as the governing body of the Judiciary, has among its main functions the guarantee of the independence for the Judges and Magistrates that form the judicature. However, we will notice in this work that it is not the only one, considering that the GCPJ has another roles directly related with the government of the Judiciary, such as, among others, the disciplinary function directly exercised over Judges and Magistrates. That is why we must analyze the possible interferences which may be caused in the judicial independence by political power. Since the EC of 1978, with the influence of neighboring states like France, Italy or Portugal, it was established a system of composition and designation for the members of the GCPJ in the article 122.3 EC with the reference, for its complement, to the legislative development. We will delve into the study (in a triple dimension: legislative, doctrinal and jurisprudential) of the systems determined by the legislator (starting from the OL 1/1980 until the last reform carried out through by the OL 4 / 2013), discovering how there has been a turn towards the greater interventionism from the Legislative Chmabers in the procedure of designation of the GCPJ members and a relative subsequent correction.
