dc.description.abstract[ES]La legislación es un elemento básico para el desarrollo tecnológico. Por ejemplo, los ataques de denegación de servicio (DdS) podrían incluirse en el tipo de referencia del Código Penal español, en cuanto suponen inutilizar programas y datos contenidos los servidores que actúan en la red, por cuanto queda impedido el acceso a los mismos por parte de sus usuarios. La propuesta de Decisión marco es mucho más clara al respecto, al señalar la necesidad de tipificar como delito el hecho de obstaculizar e interrumpir significativamente el funcionamiento de un sistema informático no sólo bo-rrando, alterando o deteriorando, sino también “introduciendo o transmitiendo” datos in-formáticos, con el fin de saturar deliberadamente los sistemas de un concreto prestador de servicios en la red. Este es uno de los muchos ejemplos que se analizarán en este capítulo y que proporcionan una idea de lo importante que es legislar correctamente.es_ES
dc.description.abstract[en]Legislation is a basic element for technological development. For example, denial of service (DoS) attacks could be included in the reference type of the Spanish Criminal Code, insofar as they involve disabling programs and data contained in the servers that act on the network, since access to them by their users is prevented. The proposal for a Framework Decision is much clearer in this respect, pointing out the need to criminalise the act of significantly hindering and interrupting the operation of a computer system not only by erasing, altering or deteriorating, but also by "introducing or transmit-ting" computer data, in order to deliberately saturate the systems of a specific service provider on the network. This is one of the many examples that will be discussed in this chapter and that provide an idea of how important it is to legislate correctly.
