El Consejo General del Poder Judicial: consideraciones generales e independencia judicial

Abstract

[ES] El Consejo General del Poder Judicial es el órgano de gobierno de los Jueces y Magistrados en España. Su labor fundamental es la de garantizar su independencia en el ejercicio de su función jurisdiccional. Esta tarea es fundamental para asegurar el correcto equilibrio entre poderes y el cumplimiento de los fines propios del Estado de Derecho. A lo largo de sus cuatro décadas de actuación ha sufrido numerosas reformas legislativas tendentes a establecer variaciones en cuanto a la forma de elección de sus vocales -principalmente para aumentar la influencia de las Cortes Generales-, aunque también se han modificado competencias y atribuciones. La institución del CGPJ -a partir del artículo 122 de la Constitución y del posterior desarrollo legislativo-, la independencia de Jueces y Magistrados, y el nombramiento de los vocales serán las líneas de análisis en torno a las cuales girará este trabajo, prestando atención tanto a la doctrina como a la legislación y jurisprudencia.

[EN] The General Council of the Judicial Power is the government institution of Judges and Magistrates in Spain. Its main aim is to guarantee the independence of its subordinates in their exercise of the jurisdictional duty. This task is crucial in order to ensure the correct equilibrium between powers and the achievement of the purposes of the State of Law. During the four decades of its operation has suffered many legislative changes which tended to stablish variations in the election model of its vocals -mainly in order to increase the influence of the Legislative Houses-, even though some of its functions and powers also have been amended. The CGPJ institution -from the article 122 of the Constitution and posterior legislative development, the independence of Judges and Magistrates, and the designation of the vocals will be the line of analysis of this essay, paying attention not only to the doctrine but also the legislation and jurisprudence.
