[ES] La obra debe ser considerada como un bien o derecho patrimonial independiente sobre la que gravitan los exclusivos de la propiedad intelectual, y como tal objeto de comercio. El esfuerzo del autor debe recompensarse como un valor patrimonial, siendo a quien le corresponde establecer la licencia bajo la que publicar según la expectativa remuneratoria de su trabajo. Ante el articulado normativo sobre la compensación equitativa de derechos, se critica la falta de intervención de algún agente. El avance tecnológico hace que surjan medidas de protección consecuentes con el desarrollo, incluidas acciones más efectivas e inmediatas. Sin embargo, la insuficiencia de acciones de protección efectivas e inmediatas provocará tanto que la obra se devalúe en el mercado como que se incremente el perjuicio económico del haber patrimonial del autor. Deberá optar por la mejor defensa de sus derechos, tanto el patrimonial como los inherentes a la obra, pero la práctica le conducirá a dejarse tutelar por la intervención de la administración. [EN] The author's work must be considered as an independent property or patrimonial right on which the exclusive rights of intellectual property gravitate, and as such an object of commerce. The effort made by the author should be rewarded as a patrimonial value, and it is up to him to establish the license under which to publish according to the remuneration expectation of his work, of his work. Faced with the normative articulation on the equitable compensation of rights, the lack of intervention of some agents is criticized. Technological advancement leads to the emergence of protection measures consistent with development, including more effective and immediate actions. The insufficiency of effective and immediate legal actions for protection will not only cause the work to be devalued in the market, but also increase the economic damages of the author's assets.
