[ES] La obra debe ser considerada como un bien o derecho patrimonial independiente sobre la que gravitan los exclusivos de la propiedad intelectual, y como tal objeto de comercio. El esfuerzo del autor debe recompensarse como un valor patrimonial, siendo a quien le corresponde establecer la licencia bajo la que publicar según la expectativa remuneratoria de su trabajo. Ante el articulado normativo sobre la compensación equitativa de derechos, se critica la falta de intervención de algún agente. El avance tecnológico hace que surjan medidas de protección consecuentes con el desarrollo, incluidas acciones más efectivas e inmediatas. Sin embargo, la insuficiencia de acciones de protección efectivas e inmediatas provocará tanto que la obra se devalúe en el mercado como que se incremente el perjuicio económico del haber patrimonial del autor. Deberá optar por la mejor defensa de sus derechos, tanto el patrimonial como los inherentes a la obra, pero la práctica le conducirá a dejarse tutelar por la intervención de la administración.
