La inteligencia artificial en el proceso penal: especial referencia al reconocimiento facial.

Abstract

[ES] La inteligencia artificial es un fenómeno reciente, que ha cobrado fuerza en nuestra sociedad en las últimas décadas y que está estrechamente vinculado a las Nuevas Tecnologías y al Big Data. La inteligencia artificial ha impregnado cada ámbito de nuestras vidas, incluido el mundo del Derecho y, más concretamente, el proceso penal. En el presente trabajo se pretende analizar esa interacción IA – proceso penal, cómo puede afectar la inteligencia artificial al Derecho y al proceso, qué ventajas y desventajas presenta, cuál es su regulación tanto a nivel de la Unión Europea como nacional, haciendo una especial referencia al reconocimiento facial mediante IA. Para ello se llevará a cabo una revisión bibliográfica de autores que han tratado el tema con anterioridad, así como un análisis de informes y proyectos de los grupos de trabajo de las instituciones europeas y del marco normativo que lo acompaña, para finalizar con una breve reflexión acerca de este fenómeno. [EN] Artificial intelligence is a recent phenomenon, which has gained strength in our society in the last decades and is closely related to New Technologies and Big Data. Artificial intelligence has permeated every area of our lives, including law and, more specifically, the criminal process. The aim of this paper is to analyse the interaction between AI and the criminal process, how artificial intelligence may affect other legal issues and proceedings, its advantages and disadvantages, and its regulation at both the european and national level, with a special reference to facial recognition using AI. To this end, a bibliographical review of authors who have previously dealt with the subject will be carried out, as well as an analysis of reports and projects of the working groups of the European institutions and the regulatory framework that accompanies it, to conclude with a brief reflection on this phenomenon.
