Sustracción internacional de menores: oposición a la restitución. la opinión del menor y el derecho a ser oído.

Abstract

[ES] El presente trabajo tiene por objeto el estudio de la sustracción internacional de menores, fenómeno de bochornosa actualidad que ha ido cobrando cada vez más importancia al mismo tiempo que la globalización se va haciendo cada vez más evidente en nuestros días. Y es que el cambio en las relaciones sociales que la apertura de fronteras y las relaciones cada vez más estrechas entre países ha dado lugar al surgimiento de problemas como lo es el tratado y a su vez al aumento de los intentos de cooperación jurídica entre Estados para resolverlos, tales como la ratificación de diversos convenios que tratan de regular este tipo de situaciones. Así pues, en el presente texto se comenzará definiendo el problema de la sustracción internacional de menores, así como la restitución inmediata del menor a su país de origen como principal solución ofrecida. Por otro lado, se analizarán los mecanismos de oposición al retorno del menor secuestrado, más concretamente el que versa sobre la opinión del menor y su derecho a ser oído, con especial hincapié hacia los casos en los que existe violencia de género, en base a lo descrito en la Ley Orgánica 8/2021, de protección de la infancia y la adolescencia frente a la violencia. Por último, se hará referencia a la mediación como método de resolución de conflictos de esta índole, tal y como lo recoge el Reglamento 2019/1111 y su adecuación en función del caso concreto. [EN] The aim of this paper is to study international child abduction, a phenomenon of shameful topicality which has become increasingly important at the same time as globalisation is becoming more and more evident in our days. The change in social relations, the opening of borders and the ever closer relations between countries has led to the emergence of problems such as the treaty and, in turn, to an increase in attempts at legal cooperation between States to resolve them, such as the ratification of various conventions which attempt to regulate this type of situation. Thus, this text will begin by defining the problem of international child abduction, as well as the immediate return of the child to his or her country of origin as the main solution offered. On the other hand, the mechanisms of opposition to the return of the abducted child will be analysed, more specifically the one that deals with the opinion of the child and his or her right to be heard, with special emphasis on cases in which there is gender violence, based on what is described in Organic Law 8/2021, on the protection of children and adolescents against violence. Finally, reference will be made to mediation as a method of resolving conflicts of this nature, as set out in Regulation 2019/1111 and its suitability depending on the specific case.
