La protección temporal frente a la crisis de Ucrania: la activación de la directiva 2001/55/CE

Abstract

[ES] El objeto de este trabajo es analizar desde un punto de vista jurídico la crisis migratoria provocada por la agresión militar de Rusia hacia Ucrania, iniciada en febrero de este año y que continúa hasta hoy, siendo la causa de la afluencia masiva de personas desplazadas, además de la consecuente activación de la Directiva 2001/55/CE sobre protección temporal por primera vez desde su adopción. Se trata de un tema de enorme interés y actualidad, que está teniendo importantes consecuencias en la Unión Europea y en sus Estados miembros. Para alcanzar este objetivo, mediante una revisión bibliográfica, se profundizará en la gestión de la Unión Europea ante esta situación, comenzando con un marco teórico, en el que se abordarán de manera general el Sistema Común de Asilo, el principio de no devolución, el estatuto del refugiado, la protección subsidiaria, y de manera más específica, la protección temporal. Se continuará con el análisis de la Directiva 2001/55/CE, en un contexto más amplio y de la Decisión de Ejecución del Consejo 2002/382, en relación con la crisis de Ucrania. Finalmente, se ahondará en la respuesta dada por España ante esta situación y sus decisiones dentro del margen de discreción otorgado por la normativa ya mencionada. [EN] The object of this thesis is to analyse from the point of view of the law, the migratory crisis caused by the military aggression of Russia towards Ukraine, initiated on February of this year and which continues until this day, being the cause of a max influx of displaced people, in addition to the consequent activation of Directive 2001/55/EC on temporary protection for the first time since its adoption. It constitutes an issue of great interest and currency, having important consequences on the European Union and its Member States. In order to achieve this goal, through a bibliographic revision, it will deepen into the management of the EU of this situation, starting off with a theoretical framework, explaining concepts such as the Common European Asylum System (CEAS), the principle of non-refoulement, the statute of the refugee, the subsidiary protection and, more specifically, the temporary protection. It will continue with the analysis of Directive 2001/55/EC, in a broader context and of Council Implementing Decision 2002/382, in the context of the war in Ukraine. Lastly, it will fathom into the answer given by Spain to this situation and its decisions within the margin of appreciation provided by the already mentioned norms.
