Análisis textual y jurídico comparado para la traducción: el caso de las capitulaciones matrimoniales alemanas y españolas

Abstract

[EN] Interlingual and intercultural comparison of legal text types provides evidence of the distinctive features of the legal systems in which the texts are based, as well as revealing different textual conventions that characterize national legal languages. Therefore, comparative analysis can yield valuable insights for the translation of legal texts, which involves two different legal systems and two distinct linguistic cultures. The aim of this paper is to demonstrate this hypothesis by comparing German and Spanish nuptial agreements using a comparative legal and text-analytical methodology.

[SP] La comparación interlingüística e intercultural de los tipos de textos jurídicos proporciona evidencia de las características distintivas de los sistemas legales en los que se basan los textos, además de revelar diferentes convenciones textuales que caracterizan los lenguajes jurídicos nacionales. Por lo tanto, el análisis comparativo puede ofrecer valiosos aportes para la traducción de textos jurídicos, que implica dos sistemas legales diferentes y dos culturas lingüísticas distintas. El objetivo de este artículo es demostrar esta hipótesis comparando los acuerdos prenupciales alemanes y españoles mediante una metodología analítica y comparativa del derecho y el texto.
