Las nuevas administraciones locales: el pequeño municipio tras la reforma de la Administración Local

Abstract

[EN] En el presente trabajo se abordará la cuestión de las Entidades Locales Menores, desde su nacimiento, hasta nuestros días. Se hará un resumen detallado de todos los avatares que esta figura ha sufrido, sobre todo a raíz de la reforma del 2013 con la LRSAL (a nivel estatal) y con la Ley 7/2013 de 27 de septiembre (a nivel autonómico). El estudio se centrará en la Comunidad de Castilla y León, analizando la situación anterior y actual de las Entidades Locales Menores en la misma, por ser esta Comunidad la que más Entidades Locales Menores tiene de todo nuestro país. Veremos también como la pervivencia de las Entidades Locales Menores está en entredicho, ya que, entre otros motivos, la legislación estatal, y la legislación autonómica tienen métodos contrapuestos a la hora de legislar sobre esta cuestión. Hablaremos así mismo de la Provincia, y en concreto, de su órgano de Gobierno: las Diputaciones Provinciales, ya que son objeto obligado de comentario puesto que se han consolidado asumiendo nuevas competencias tras la reforma legislativa efectuada.

[EN] In the present work I approach the issue of Minor Local Entities, from their birth to the present day. I will make a detailed summary of all the avatars that this figure has suffered, especially as a result of the 2013 reform with LRSAL (state level) and Law 7/2013 of September 27 (at the regional level). The study will focus on the Community of Castilla y León, analyzing the previous and current situation of the Minor Local Entities in it, because this Community is the most Minor Local Entities have all of our country. By other side, I will also suggest how the survival of the Minor Local Authorities is in question, since, among other reasons, the state legislation and the regional legislation have different methods when legislating on this issue. I will also speak of the Province, and in particular, of its governing body: the Provincial Councils, due to their obligatory commentary, since they have consolidated by assuming new competences after the legislative reform carried out.
