El derecho a la interpretación y a la traducción en el espacio europeo multinivel

Abstract

[ES] Para garantizar que los procesos sean justos, a los acusados o sospechosos se les reconocen una serie de derechos que les permiten ejercer efectivamente su defensa. Entre ellos, encontramos los complementarios derechos a la interpretación y a la traducción, cada vez más presentes debido a la evolución de la integración en la Unión Europea y de la globalización. A lo largo del tiempo, el contenido que constituye sendos derechos se ha ido perfilando a través de numerosos pronunciamientos de los tribunales que configuran el espacio europeo multinivel y progresivos desarrollos legislativos. De manera que los acusados o sospechosos que desconozcan el idioma empleado en el proceso contarán, simultáneamente y ambos con carácter gratuito, con el derecho a la asistencia de un intérprete en todas sus fases y a la traducción de los documentos esenciales que vayan surgiendo. Debiendo contar, ambas, con una calidad tal que permita salvaguardar la equidad. Al respecto, los Jueces y Tribunales han de desempeñar una labor muy importante, determinando cuándo debe precisarse de asistencia lingüística, y, posteriormente, supervisando el servicio desempeñado por traductores e intérpretes. [EN] To ensure fair trials, defendants or suspects are granted a number of rights to enable them to effectively exercise their defence. Among these are the complementary rights to interpretation and translation, which are increasingly present due to the evolution of integration into the European Union and globalisation. Over time, the content of these rights has been shaped by numerous rulings of the courts that make up the multi-level European area and progressive legislative developments. Thus, defendants or suspects who do not know the language used in the proceedings will have, simultaneously and both free of charge, the right to the assistance of an interpreter at all stages of the proceedings and to the translation of essential documents as they arise. Both must be of such a quality as to safeguard fairness. Judges and Courts have a very important role to play in this respect, determining when linguistic assistance is required, and subsequently supervising the service provided by translators and interpreters.
